La legitimación iusnaturalista del derecho positivo en I. Kant

En el presente trabajo vamos a presentar tres modos distintos de abordar el derecho positivo con vistas a ilustrar la legitimación kantiana del estado civil por medio del abandono del estado de naturaleza. El primero de ellos remite a la Teoría pura del derecho de Hans Kelsen y a su positivismo jurídico puramente descriptivo. El segundo modo que vamos a considerar es el positivismo ético o normativo de J. Waldron y su defensa prescriptiva del derecho positivo. Por último, y fundamentalmente a partir de los trabajos de J. Waldron sobre el positivismo jurídico de Kant extraeremos las razones de fondo de la defensa iusnaturalista del derecho positivo presente en la “Doctrina del derecho” de la Metafísica de las Costumbres.
