Governmental interference in private and family life

Abstract

This article is about legal regulation of private and family life. It proposes to reflect about the public-private distinction from a gradual perspective, beyond the conception of personal autonomy as an absolute capacity; instead, the article focuses on an interpersonal, contextual and action-oriented approach. This new perspective allows a better understanding of the role of governmental institutions and the law, as regarding family relations and conflicts.

Silvina Alvarez Medina, Universidad Autónoma de Madrid

Profesora de Filosofía del Derecho. Con anterioridad ha sido profesora Ramón y Cajal en la UAM y profesora visitante en la Universidad de Oxford, el Instituto Universitario Europeo de Florencia, la Universidad Pompeu Fabra y la Universidad de Sussex. Ha trabajado sobre temas de filosofía moral y política, comunitarismo y multiculturalismo, derechos humanos, derechos de las mujeres.
