The EU's response to refugees from Ukraine: a one-time exception or a change of perspective?

Abstract

In this paper we want to make a modest contribution to the debate on the system of shared responsibility between the Member States (MS) of the EU for the reception and protection of asylum seekers in European territory. The following lines will look with hope -not exempt from critical analysis- at the activation of the European Directive on Temporary Protection (TPD) for the reception of people fleeing the war in Ukraine. Thus, we will try to find certain positive elements in the activation of the aforementioned Directive and reflect on a possible "new model" in which shared responsibility would be fully binding on the MS and, furthermore, in which the distribution of asylum seekers between said MS would take into account the objectively individualized circumstances of the applicants (certain agency of the applicants for their own distribution). Some lessons could make us rethink certain EPMA 2020 proposals.
