Resum

El multilingüisme es percep sovint com una càrrega per a les institucions judicials acostumades a fer procediments en una llengua específica. Això no obstant, en traduir recursos i proves d'una llengua diferent de la llengua d'un procediment, es permet als tribunals redactar sentències basades en un conjunt monolingüe de recursos potencialment amb una referència mínima o nul·la a la llengua d'origen. Aquest article pretén revelar aquest mite del monolingüisme judicial, mostrant com actuen els tribunals multilingües quan els recursos indispensables només estan disponibles en una llengua diferent de la del procediment. Mitjançant l'anàlisi de sentències penals monolingües dictades en jutjats de pau de la província bilingüe (alemany/italià) del Tirol del Sud (Itàlia), aquest article mostra com, en citar jurisprudència disponible únicament en italià, s'introdueixen rastres d'italià en sentències redactades en alemany. Mitjançant un estudi quantitatiu, s'analitzen tres maneres d'abordar aquesta qüestió (i) els collages entre les dues llengües; (ii) la cita directa de l'italià; i (iii) la traducció. L'article analitza críticament aquests tres enfocaments i destaca un enfocament alternatiu, consistent en una combinació entre la cita directa de l'italià i una traducció a l'alemany, per tal de garantir tant la seguretat jurídica com una comprensió adequada per a totes les parts interessades.
